Osvaldo Diaz is a 69-year-old man accused of groping an 11-year-old girl inside a hotel swimming pool in Miami Beach. The allegations have led to criminal charges and a lawsuit worth more than $15 million against the hotel where the incident allegedly happened.
Alleged Incident at Hotel Pool
Police documents say the alleged incident happened at the Radisson Hotel located on Collins Avenue and 43rd Street in Miami Beach. The 11-year-old girl and her family were reportedly visiting the area from Sweden and staying at the hotel during the time of the alleged assault.
Investigators say the child was swimming in the pool with other guests when Diaz allegedly approached her. According to an arrest affidavit, Diaz allegedly grabbed the girl’s buttocks while she was in the water.
The child reportedly first believed the touching may have been accidental. However, authorities claim that when she went underwater to avoid him, Diaz allegedly followed her and touched her inappropriately between her legs.
Police say the child quickly left the pool after the incident and informed her siblings and parents about what had happened. According to investigators, she specifically told her father that Diaz had touched her inappropriately while she was swimming.
Authorities also said the child did not know Diaz before the incident.
What Happened Afterward
According to the affidavit obtained by People, Diaz allegedly left the pool area after the incident and went toward a nearby hotel. The girl’s father reportedly followed him and confronted him before hotel security was contacted.
Police documents claim Diaz tried to flee when officers arrived at the scene. However, hotel security reportedly maintained visual contact with him until authorities detained him.
Diaz was later taken to a police station for questioning. Investigators say he admitted seeing the child in the pool but denied having any interaction with her.
A hotel manager later confirmed that Diaz was not a registered guest at the hotel and had entered the private pool area illegally.
Charges Against Osvaldo Diaz
Jail records show Diaz was arrested on Oct. 27, 2025. He was later charged with lewd and lascivious battery on a child and burglary with assault or battery.
Authorities say Diaz remains in custody while the investigation continues. His bail was reportedly set at $15,000.
Family Files Lawsuit
The child’s family has now filed a lawsuit against the Radisson Hotel, claiming poor security allowed the alleged incident to happen. The lawsuit seeks more than $15 million in damages.
The girl’s mother reportedly said she did not see security guards at the hotel at any point during their stay. The family’s attorney, Justin Shapiro, also criticized the hotel’s security measures.
"We believe this hotel had no security at that point and that is what invites crime like this," the family's attorney Justin Shapiro told the outlet.
